Camera Access Agreement

1. Parent access to this Service is intended to foster comfort and not serve as a surveillance system for events that take place at the Center. Accordingly, Loving Arms is not obligated to archive or otherwise maintain videotape or other reproduction of the content which appears on the Service for future reference.

2. In an effort to protect the interests of each Parent, their children and the Center, you represent and warrant to Loving Arms™ Child Care and Preschool that

   a. You are the natural or adoptive parent or legal guardian of a child (or children) in a child care program, or you are the authorized representative of such parent or legal guardian, and

   b. The information you provide to Loving Arms is accurate and complete. In the event that any such information changes, you agree to promptly communicate such changes to Loving Arms.

3. Loving Arms™ Child Care and Preschool will never ask you for your password after the initial signing of this agreement. You are responsible for the security and use of your password. You must never respond to a request for this password to safeguard your privacy.

4. You shall not use the Service for any unlawful or inappropriate purpose, including but not limited to:

   a. (a) any violation of the legal rights (including the rights of privacy and publicity) of others,

   b. (b) transmission of any defamatory, harmful, obscene, threatening, vulgar, profane, abusive or racially, ethnically or otherwise objectionable or unlawful material, and

   c. the knowing upload or transmission of files that contain a virus or otherwise corrupted data or which cannot be distributed legally over the Services.

5. Your misuse or abuse of the Service may result in your denial of access to the Service and that your account may be terminated for excessive use (for example creating a script to automatically refresh images).

6. You acknowledge that Loving Arms™ Child Care and Preschool may disclose personal information about you if:

   a. such information is subpoenaed,

   b. Loving Arms™ Child Care and Preschool believes a user is using the Service or Site to commit unlawful acts or acts that endanger the health, safety or welfare of another user or the general public, or

   c. Loving Arms™ Child Care and Preschool believes it is necessary in connection with activity that may be illegal or expose Loving Arms™ Child Care and Preschool to legal liability.

7. Nontransferable. Your right to use the Site is not transferable. Any user name, password or right given to you to obtain information or documents is not transferable. Member will use their own password. Member is responsible for the security and use of their own password. Member assumes and is solely responsible for all damages, losses, costs and expenses arising as a result of Member's permitting any other person to use it's password and Member shall assume any and all resulting liabilities (whether civil or criminal) of such use, including responsibility for any and all Content (as defined herein) accessed on the Site, hold Loving Arms™ Child Care and Preschool , and Center, their affiliates and any of their respective officers, directors, employees and other agents (herein "Agents") harmless for any such use of Loving Arms™ Child Care and Preschool by a person other than Member.

8. Termination; Assignment Loving Arms™ Child Care and Preschool reserves the right to terminate this Agreement without notice if Member no longer has a child or children enrolled in a program at the Center (the "Program") or if Loving Arms™ Child Care and Preschool believes it would be in the best interest of the system and/or the Center or its clients. In the event of termination of this Agreement, Member's password will be deactivated.

9. Loving Arms™ Child Care and Preschool does not pre-screen Content as a matter of policy; however, Loving Arms™ Child Care and Preschool shall have the right, in their sole discretion, but not the responsibility, to remove Content that they may believe to be harmful, offensive or otherwise in violation of the Agreement or any applicable laws. Accordingly, Loving Arms™ Child Care and Preschool shall not assume or have any liability for any action or inaction by Loving Arms™ Child Care and Preschool or its affiliates with respect to Content on, or Content changes within, the Site.

10. Loving Arms™ Child Care and Preschool reserves the right to change classroom assignments during the day. On occasion, this may mean that your camera access rights may not coincide with the actual room assignment of your child.

11. In addition, Loving Arms™ Child Care and Preschool is not responsible for or obligated to take any steps to verify the accuracy, completeness, timeliness, usefulness and/or correct sequencing of any Content included in the Service. Neither Loving Arms™ Child Care and Preschool , its affiliates nor their respective officers, directors, agents and employees makes any warrant, express or implied, of any kind whatsoever, and none of these parties shall be liable for any losses, damages, costs or expenses, of any kind and description (including indirect, special, consequential or incidental damages), relating to the accuracy, completeness, timeliness, usefulness or correct sequencing of any Content on the Site, the use of Content on the Site, or the quality of usage or the results that may be obtained from the Loving Arms™ Child Care and Preschool Services. The Services are provided on an "as is" basis, and Loving Arms™ Child Care and Preschool does not make any warranties, express or implied, of any kind as to the Services, including but not limited to any warranty of merchantability or fitness for a particular purpose. Loving Arms™ Child Care and Preschool does not represent or warrant that the Service will never be suspended or terminated.

12. The Content posted on the Site is confidential and proprietary to Loving Arms™ Child Care and Preschool ;and Loving Arms™ Child Care and Preschool may incur damages, losses and costs and expenses if such Content is provided or otherwise made available to unrelated third parties in violation of the Agreement. In addition, Loving Arms™ Child Care and Preschool permits access to Content that is protected by copyrights, trademarks and other intellectual and proprietary rights ("Rights"). These Rights are valid and protected in all media and technologies existing now or later developed and except as explicitly provided, applicable copyright and other laws govern the Center's use of Content. The Content is subject to certain legal rights (including the rights of privacy and publicity) of others.

Acceptance of Agreement

1. You agree to the terms and conditions outlined in this Terms and Conditions of Use ("Agreement") with respect to our site (the "Site"). Except as otherwise set forth herein, this Agreement constitutes the entire and only agreement between us and you, and supersedes all prior or contemporaneous agreements, representations, warranties and understandings with respect to the Site, the content, products or services provided by or through the Site, and the subject matter of this Agreement. This Agreement may be amended at any time from time to time by us without specific notice to you. The latest Agreement will be posted on the Site, and you should review this Agreement prior to using the Site.

Copyright

1. The content, organization, graphics, design, compilation, magnetic translation, digital conversion and other matters related to the Site are protected under applicable copyrights, trademarks and other proprietary (including but not limited to intellectual property) rights. The copying, redistribution, use or publication by you of any such matters or any part of the Site, except as expressly allowed under this contract, is strictly prohibited. You do not acquire ownership rights to any content, document or other materials viewed through the Site. The posting of information or materials on the Site does not constitute a waiver of any right in such information and materials.

Limited Right to Use.

1. The viewing, printing or downloading of any content, graphic, form or document from the Site grants you only a limited, nonexclusive license for use solely by you for your own personal use and not for republication, distribution, assignment, sublicense, sale, preparation of derivative works or other use. No part of any content, form or document may be reproduced in any form or incorporated into any information retrieval system, electronic or mechanical, other than for your personal use (but not for resale or redistribution).
